How Springfield Divorce Cases Work

Springfield divorce cases follow Missouri state law. Under RSMo 452.305, at least one spouse must have lived in Missouri for 90 days before filing. You file the petition at the Greene County Circuit Court. Missouri only recognizes no-fault divorce. The sole ground is that the marriage is irretrievably broken, as stated in RSMo 452.320. There is no option to file on fault-based grounds in Springfield or anywhere else in the state.

After the petition is filed and the other spouse is served, a 30-day waiting period applies. The court cannot finalize the divorce before that time passes. If both parties agree on everything, including property and custody, the case can be resolved soon after the waiting period. Contested Springfield divorces take much longer, sometimes six months or more, depending on the issues involved. Property division follows Missouri's equitable distribution approach under RSMo 452.330.

The Missouri Courts website has all the forms you need to file for divorce in Springfield. The packet includes the petition, financial statements, and parenting plan forms if children are part of the case. Every person who represents themselves must use the Supreme Court-approved forms. The 31st Circuit may have local rules that add requirements, so check with the Greene County clerk before you submit your paperwork.

Note: Springfield residents can also access free legal research computers at Missouri State University's library for filling out court forms.
